Modification of a divorce or custody case

Often divorce or custody cases are entered when the children are young. While everyone tries to craft an agreement that will last for many years to come, sometimes things change. For the court to modify custody of children, there needs to be change that was not in the contemplation of the court at the time the original order was entered, the change must be substantial and not temporary. If the court determines there has been a change in circumstances, the court must then determine if it is in the best interests of the children to change custody.
